What is Probate?

Statutory Fees Explained:

The statutory fee schedule is as follows:

  • 4% on the first $100,000 of the gross estate value
  • 3% on the next $100,000
  • 2% on the next $800,000
  • 1% on the next $9,000,000
  • 0.5% on the next $15,000,000
  • For estates above $25,000,000, a reasonable amount determined by the court.

It's crucial to remember that both the attorney and the personal representative are entitled to these statutory fees, meaning the total statutory fees for the estate will be double the amount calculated by this schedule.

Extraordinary Fees:
In addition to statutory fees, attorneys and personal representatives may petition the court for "extraordinary fees" for services beyond the ordinary administration of the estate. These can include services related to selling real property, handling litigation, tax matters, or operating a business.
