Understanding CICA Compensation

The Criminal Injuries Compensation Authority (CICA) is a government-funded body in the United Kingdom that provides financial compensation to victims of violent crime. Unlike civil personal injury claims, CICA operates on a fixed "Tariff of Injuries," ranging from £1,000 to £250,000 for physical and psychological harm.

The Multiple Injuries Rule

If you have suffered more than one injury in a single attack, CICA does not simply add the values together. They apply a specific formula known as the "Multiple Injuries Rule":

  • 100% of the value for the most serious injury.
  • 30% of the value for the second most serious injury.
  • 15% of the value for the third most serious injury.

Any injuries beyond the top three are generally not compensated unless they resulted in a loss of pregnancy or certain other specific conditions.

Additional Compensation Components

Beyond the physical injury tariff, you may be eligible for:

  1. Loss of Earnings: If you have been unable to work for more than 28 full weeks as a direct result of the injury, you may claim loss of earnings based on the statutory sick pay rate.
  2. Special Expenses: This covers costs such as physical aids (wheelchairs), home adaptations, or the cost of care if you require assistance with daily living.

CICA Eligibility Example

Scenario: An individual suffers a broken jaw (Tariff: £3,500) and a significant facial scar (Tariff: £2,400).

Calculation:

  • Primary Injury (Jaw): £3,500 (100%)
  • Secondary Injury (Scar): £720 (30% of £2,400)
  • Total Estimated Award: £4,220

Important CICA Deadlines

It is vital to note that CICA claims must typically be submitted within two years of the date of the incident. Furthermore, the crime must have been reported to the police as soon as reasonably practicable. Failure to cooperate with the police or having a criminal record may lead to a reduction or rejection of the claim.
