Good Time Credit (The 75% vs. 50% Rule)
Indiana uses "Credit Classes" to determine how much of a sentence must be served behind bars. This is the most critical factor in estimating a release date:
- Level 6 Felonies & Misdemeanors: Usually fall under Credit Class A. Defendants earn 1 day of credit for every 1 day served, meaning they serve 50% of their sentence if they maintain good behavior.
- Level 1 through Level 5 Felonies: Usually fall under Credit Class B. Defendants earn 1 day of credit for every 3 days served, meaning they must serve 75% of the imposed sentence.
- Murder: Also typically follows the 75% rule for offenses committed after the 2014 reform.
Example Calculation
If an individual is sentenced to 12 years for a Level 3 Felony:
- Identify the Credit Class: Level 3 felonies require 75% time served.
- Calculation: 12 years x 0.75 = 9 years.
- The individual would likely serve 9 years in the Indiana Department of Correction, assuming no loss of good time credit.
